However, with a judicial notice demand for dismissal, you are making a statement and placing the burden of proof on the court. A demand for dismissal can have the same format as a motion to dismiss, but instead of saying "motion to dismiss," you simply state "judicial notice demand for dismissal." For example, if you receive a traffic ticket, you can print this demand and send it without pleading, thus avoiding receiving a court notice in the mail. However, never enter a plea until you can go to court and challenge the jurisdiction of the charges. It is important to ensure that the proper jurisdictions are established before proceeding. Furthermore, be cautious of word games played by judges. When a judge asks if you would like to proceed, ignore the question and instead state that you want the case to be dismissed. By answering "yes" or "no," you may inadvertently contract with the court. Similarly, when asked if you understand, always respond with "no, sir. I am not a lawyer and I do not understand." If you suspect a question may have a hidden meaning, either claim lack of understanding or ignore it and reiterate your demands. Remember, the only reason you are in court is because you have been threatened with arrest if you do not comply.
